This is in response to George McElroy's letter last week regarding police brutality here in Josephine County..

Allow an honorably retired Police Sergeant living on pension, offer some insight on the level of Law Enforcement personally experienced at the hands of the Josephine County Sheriff's Office, and their money grubbing corporate corrupt courts. IT STINKS!!

What they lack in competence, they more than make up with force used upon people who are not criminal, but just unlucky to be in the wrong place at the wrong time. The recent campaign of Highway Piracy at the hands of JOCO deputies (Unlawfully impounding of automobiles) is testimony to that fact.

Seven years ago, I was arrested at gunpoint by 4 JOCO sheriffs deputies after leaving a traffic stop after being told 4 times I was not under arrest.

The original offense? My automobile HiBeams were on as I was travelling home on hwy, 199. in my private automobile, not engaged in commerce, therefore not required by law to have a "driver license." a document designed toward regulating commerce on the highway and binding otherwise, unaware people to a multitude of vehicle code infractions via unlawful adhesion contracts which lack full disclosure of terms at time of application.

Like Paul Jackson, they pyramided charges on me hoping I would cop to a plea and they would make a few easy bucks via fines and court charges.. They threatened me with 35 years in prison, but were willing to reduce it to time served if I would plead guilty. I rejected the offer, went through 2 fraudulent trials by a special prosecutor brought in from the Attorney General's Office.

The deck was stacked. When convicted, I refused to accept the corporate court's offer of sentencing, since NONE of the judges, District Attorney, or anyone in the Attorney Generals Office would show under oath or affidavit proof of their jurisdiction over this Living, Breathing, Flesh-and-Blood, Sentient, Natural man. I was/am not a person as defined in the Color of Law Statutes, nor am I a 14th amendment citizen which makes me a slave and a "ward of the Court" in the minds of the doubletalking public officials.

After holding the Judges, District Attorney, and Sheriff responsible for their fraudulent enforcement of "Color of Law" upon one over whom they had no JURISDICTION. numerous Proof of Claims accompanied by Affidavits leading to UCC liens were placed against the Judges, Prosecutors, and Sheriffs Deputies, all of which they defaulted on via Commercial Law, they decided they were going to flex their muscles and try me as a "Paper Terrorist."

A total of 128 days were spent in total in incarceration, 121 days in "the hole" held in an isolation cell in the Maximum security Wing of the Jail 23 hrs a day with 1 hour out for showers etc. One would have thought that I was public enemy number one, when up until that fateful night, I had never been in jail nor had a blemish on my record, and I was approaching my 65th birthday. .

I underwent two combined hunger strikes of 55 days and was near death according to the Jail Nurse when the undersheriff Anderson dumped me off at the curb of the Three Rivers Emergency Room stating I would have to pay for the hospital care and the county would not be responsible. Was that really the issue. Dollars and Cents, and not Justice? Is that what we pay for?. By the way, throughout the last 7 years, Josephine County and the State of Oregon have not gotten a penny out of me in court costs and fines despite their "huffing and puffing." The do, however do a a landoffice business in impound costs. We have organized Piracy going on in Josephine County.

To this very day, I continue to assert my Unalienable Right to Liberty which includes the Right to travel without seeking permission from my government. Now they will not arrest me. Nor will they take me before a judge They just handcuff you, throw you in the back seat of the patrol car until the tow truck takes away your property then release you. In short they just steal my car and abandon me wherever I happen to be. The last time I demanded to be taken before the judge to get this question of Jurisdiction answered, I was driven from Cave Junction to the County Jail then abandoned there without booking, leaving me stranded in Grants Pass. It is time the people of Illinois Valley, and Josephine County wake up to what is really going on in their Sheriffs Office.

‘Unnecessary roughness’

On Sept. 10 at 10 p.m., my son-in-law, Paul, was the victim of what I call a brutal attack by three Josephine County deputies.

It began after a stop for allegedly going 55 mph in a 45 mph zone -- he was going 38 mph in a 45 mph zone. Deputy C--- ordered him to show his papers. Paul unbuckled his seatbelt and attempted to produce them, but they were out of reach. As he sat back up, Deputy C--- opened his door, grabbed him by one arm and jerked him out of the vehicle. Two other deputies had arrived, and threw him to the gravel, handcuffed him up and threw him into the side of his van.

Paul was placed into a cruiser and taken to jail. My granddaughter was placed in another cruiser. Yes, his 11-year-old daughter witnessed this brutal attack and sat there crying while watching her father being taken away, not knowing what was in store for her. Paul was charged with resisting arrest, failure to carry, reckless driving and endangering. His bail was set at $7,500.

On the way to jail, Paul said that he asked Deputy C--- why he was subjected to such violent treatment and was told by Deputy C--- , “I didn’t know who you were.” Paul plans to go to trial to demonstrate his belief that the Lord will watch over him, protect him, and test his faith. Paul is a good Christian man and truly believes that in preparation for the bad times ahead, God will empower evil people to impose hardships on us to test our faith.

rk: It isn't surprising that you DON'T GET IT. It is the present corporate structure called government which does NOT follow the law. They initiate corporate policy directing such policies toward their consensual "corporate subjects" and then call that law. I am not a "corporate subject" nor a 14th Amendment slave. Therefore their policies (legislation) do not apply to non-subjects, i.e. me. That is why I am free, and your are not.

rk: It is the LAW, the true LAW, Common Law and the Constitution (Contract stuck between the Sovereign People and its servant government) which accounts for my present freedom from the fraudulent actions of black robed criminals who had attempted to strip away my rights and threatened to send me to prison for 35 years. It is the same Law, which caused two judges, (Judge Neufeld, Judge Coon) one district attorney (CLAY E. JOHNSON) and one sheriff, (DAVE H. DANIEL) to be removed from their offices because of their mishandling of my case. Although I now hear that since things have cooled off Neufeld, was reinstated.

rk: Notwithstanding the fact that your anonymous posturing comes to naught and only reveals a certain lack of awareness, the solution to taking back control over our government officials is to compel them to answer fundamental questions of law themselves when standing in judgment of their fellow man. Demand the court judges and prosecutors answer under oath or affidavit under their personal, unlimited commercial liability, the challenge I have put to the court for the last 7 years of proving their JURISDICTION over me or any other Living, Breathing, Flesh-and-Blood, sentient natural man.

rk: Simple eh? Yet the STATE OF OREGON and COUNTY OF JOSEPHINE with all their seemingly power and facilities, have AVOIDED answering that question. It goes to the very heart of Freedom and Sovereignty.
